Terms and Conditions

1. Scope of Application

These Terms and Conditions govern the use of Kids Color Art services (Web App and Kiosk Terminals) for creating personalized coloring pages. By using our services, you agree to these Terms and Conditions.

2. Eligibility and Conclusion of Contract

The contract, user account, and order (both online and at the kiosk) must be concluded by an adult. Children are permitted to use the service under the supervision and with the consent of their parents or legal guardians.

3. Permitted Content & Photos of Children

You may only upload photos for which you hold the necessary rights and which do not depict explicit, violence-glorifying, or otherwise offensive content. We reserve the right to remove images that violate these provisions without prior notice.

4. Rights to Uploaded Photos

You grant us the right to process the photo exclusively for the purpose of creating the personalized coloring page you ordered. Any further use, in particular for marketing, advertising, or AI training, will not take place.

5. Special Provisions for Kiosk Terminal Use

When using our on-site kiosk terminals, the following additional provisions apply:

• Payment: Payment is made directly at the terminal using the payment methods offered there (e.g., TWINT, card).
• Failed Generation: Should the printing or image generation fail for technical reasons, please contact our support (info@neutik.ch) for a refund or a replacement code.
• Data Storage: Original photos are not stored permanently at the kiosk but are deleted no later than 15 minutes after completion or cancellation.

6. Data Protection

We treat your personal data and uploaded photos confidentially. They are shared exclusively with carefully selected processors to the extent necessary for the technical provision of the service. Further information can be found in our Privacy Policy.

7. Liability

We are liable without limitation for damages resulting from intent or gross negligence. Otherwise, our liability is limited to the breach of essential contractual obligations and to foreseeable damages. You use the Web App and the terminals at your own risk.

8. Right of Withdrawal (Exclusion for Personalized Digital Products)

The coloring pages created via our services are clearly personalized digital and physical products made to your specifications.

9. Changes to the Terms and Conditions

We reserve the right to amend these Terms and Conditions. We will inform you in a timely manner about significant changes. For ongoing orders, the Terms and Conditions valid at the time of the order apply. We will obtain your active consent for continued use of the Web App following an amendment.

10. Applicable Law and Jurisdiction

Swiss law applies. The place of jurisdiction for all disputes is, to the extent legally permissible, our registered office. Mandatory consumer protection provisions of the state of residence of users residing in the EU remain unaffected.

11. Usage Rights for the Created Coloring Page

The coloring pages you create may only be used for private purposes. Any commercial use without our explicit consent is prohibited.

12. Final Provisions

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
